Bu s\u00fcre\u00e7, Anayasa ile g\u00fcvence alt\u0131na al\u0131nan sa\u011fl\u0131k ve sosyal g\u00fcvenlik hakk\u0131n\u0131n yan\u0131 s\u0131ra, bireyin ya\u015fam hakk\u0131n\u0131 sosyal devlet anlay\u0131\u015f\u0131 ve devletin ya\u015fam hakk\u0131n\u0131 korumas\u0131 kapsam\u0131nda pozitif y\u00fck\u00fcml\u00fcl\u00fcklerinin incelenmesini de gerektirmektedir. Nitekim hem i\u00e7 hukuk d\u00fczenlemeleri hem de uluslararas\u0131 s\u00f6zle\u015fmeler devletin; bireylerin ya\u015famlar\u0131n\u0131 koruma ve sa\u011fl\u0131k hizmetlerine eri\u015fimlerini sa\u011flama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc a\u00e7\u0131k\u00e7a ortaya koymaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Buna g\u00f6re i\u015fbu \u00e7al\u0131\u015fmada, kanser tedavisinde kullan\u0131lan ve SUT (Sosyal G\u00fcvenlik Kurumu Sa\u011fl\u0131k Uygulamalar\u0131 Tebli\u011f) kapsam\u0131nda kar\u015f\u0131lanmayan ila\u00e7 bedellerinin Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan bedelsiz olarak kar\u015f\u0131lanmas\u0131 i\u00e7in izlenmesi gereken idari ve hukuki s\u00fcre\u00e7ler ile yarg\u0131 kararlar\u0131na de\u011finilecek olup, bu kapsamda yap\u0131lacak ba\u015fvuru ve devam eden s\u00fcre\u00e7te bireylere rehber olunmas\u0131 ama\u00e7lanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\" id=\"null\"\/>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"1-sosyal-guvenlik-kurumu-sgk-tarafindan-karsilanmayan-kanser-ilaclarinin-temini-icin-idari-basvuru-sureci-ile-akabinde-acilacak-dava-neticesinde-yurutulecek-hukuki-surec\"><strong>1) SOSYAL G\u00dcVENL\u0130K KURUMU (SGK) TARAFINDAN KAR\u015eILANMAYAN KANSER \u0130LA\u00c7LARININ TEM\u0130N\u0130 \u0130\u00c7\u0130N \u0130DAR\u0130 BA\u015eVURU S\u00dcREC\u0130<\/strong>&nbsp;<strong>\u0130LE AKAB\u0130NDE A\u00c7ILACAK DAVA NET\u0130CES\u0130NDE Y\u00dcR\u00dcT\u00dcLECEK HUKUK\u0130 S\u00dcRE\u00c7<\/strong><\/h4>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"11-idari-surec-turkiye-ilac-ve-tibbi-cihaz-kurumu-ile-sosyal-guvenlik-kurumu-basvurulari\"><strong>1.1. \u0130dari S\u00fcre\u00e7: T\u00fcrkiye \u0130la\u00e7 ve T\u0131bbi Cihaz Kurumu ile Sosyal G\u00fcvenlik Kurumu Ba\u015fvurular\u0131<\/strong>&nbsp;<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Endikasyon d\u0131\u015f\u0131 veya yurtd\u0131\u015f\u0131 ilac\u0131 olarak ge\u00e7en, SUT kapsam\u0131na girmeyen kanser ila\u00e7lar\u0131n\u0131n SGK taraf\u0131ndan kar\u015f\u0131lanmas\u0131 i\u00e7in \u00f6ncelikli olarak tamamlanmas\u0131 gereken idari s\u00fcre\u00e7ler vard\u0131r. \u00d6rne\u011fin etken maddeleri trifluridin ve tipiracil olan Lonsurf isimli ilac\u0131n, 2015 y\u0131l\u0131nda kolon-rektum kanseri, 2019 y\u0131l\u0131nda ise mide kanseri tedavisinde kullan\u0131lmak \u00fczere yurtd\u0131\u015f\u0131nda onaylar\u0131 al\u0131nm\u0131\u015ft\u0131r. Ne var ki, s\u00f6z konusu ila\u00e7 hen\u00fcz \u00fclkemizde Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131 taraf\u0131ndan kar\u015f\u0131lanmamakta olup, bu ilac\u0131n kullan\u0131lmas\u0131 halinde endikasyon d\u0131\u015f\u0131 onaya ba\u015fvurma ve gerekli onaylar\u0131n al\u0131nmas\u0131 halinde ancak \u00fccreti hasta taraf\u0131ndan kar\u015f\u0131lanmas\u0131 \u015fart\u0131yla ilgili ila\u00e7, T\u00fcrk Eczac\u0131lar Birli\u011fi taraf\u0131ndan temin edilmektedir. Lonsurf isimli ila\u00e7 ile s\u0131n\u0131rl\u0131 olmamak \u00fczere endikasyon d\u0131\u015f\u0131 olan ve yurtd\u0131\u015f\u0131 ilac\u0131 olarak ge\u00e7en dolay\u0131s\u0131yla temini de yurtd\u0131\u015f\u0131ndan sa\u011flanan bu t\u00fcrdeki ila\u00e7lar\u0131n d\u00f6viz kuru \u00fczerinden sat\u0131\u015f\u0131n\u0131n yap\u0131lmas\u0131, \u00fclkemizdeki d\u00f6viz kurlar\u0131n\u0131n y\u00fcksekli\u011fi g\u00f6zetildi\u011finde, hasta i\u00e7in i\u015fin psikolojik y\u00fck\u00fcne ek olarak ekonomik anlamda da a\u011f\u0131r bir y\u00fcke neden olmaktad\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu kapsamda&nbsp;<a>bu t\u00fcrdeki ila\u00e7lar\u0131n kullan\u0131m\u0131n\u0131n s\u00f6z konusu olmas\u0131 halinde \u00f6ncelikle, T\u00fcrkiye \u0130la\u00e7 ve T\u0131bbi Cihaz Kurumu&#8217;<\/a>na (T\u0130TCK) endikasyon d\u0131\u015f\u0131 ila\u00e7 kullan\u0131m\u0131na ili\u015fkin ba\u015fvuru yap\u0131lmal\u0131d\u0131r. T\u0130TCK\u2019ye yap\u0131lan ba\u015fvuru sonras\u0131nda ki\u015finin tedavisini y\u00fcr\u00fcten doktor taraf\u0131ndan ilac\u0131n kullan\u0131m\u0131n\u0131n uygun g\u00f6r\u00fcld\u00fc\u011f\u00fcne dair rapor ve re\u00e7ete ile birlikte Sosyal G\u00fcvenlik Kurumlar\u0131\u2019nda bulunan matbu dilek\u00e7e ile kuruma ba\u015fvuru yap\u0131l\u0131r. Lakin bu noktada ba\u015fvurunun ger\u00e7ekle\u015ftirilece\u011fi SGK kurumunun do\u011fru belirlenmesi \u00f6nem arz etmektedir. Yerli ila\u00e7lar i\u00e7in \u015fehir baz\u0131nda belirlenen Sosyal G\u00fcvenlik Kurumu yetkiliyken, yabanc\u0131 ila\u00e7lar i\u00e7in ba\u015fvurular Ankara \u0130bni Sina Sosyal G\u00fcvenlik Merkezi&#8217;ne yap\u0131lmaktad\u0131r.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SGK&#8217;ya ba\u015fvuru yap\u0131l\u0131rken; vekil ile ba\u015fvuru yap\u0131l\u0131yor ise vek\u00e2letname, T\u0130TCK\u2019in kabul\/red karar\u0131, tedaviyi y\u00fcr\u00fcten doktor taraf\u0131ndan yaz\u0131lan re\u00e7ete ve ba\u015fvuru dilek\u00e7esinin eksiksiz olarak sunulmas\u0131 gerekmektedir. Ba\u015fvurular genellikle iki hafta i\u00e7erisinde sonu\u00e7lanmaktad\u0131r. Yap\u0131lan i\u015fbu ba\u015fvuru reddedildi\u011fi takdirde ise ilac\u0131n bedelinin SGK taraf\u0131ndan kar\u015f\u0131lanmas\u0131 i\u00e7in hukuki s\u00fcre\u00e7 ba\u015flat\u0131lmal\u0131d\u0131r.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"12-hukuki-surec-dava-ve-ihtiyati-tedbir-talebi\"><strong>1.2.<\/strong>&nbsp;<strong>Hukuki S\u00fcre\u00e7: Dava ve \u0130htiyati Tedbir Talebi<\/strong>&nbsp;<\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">Kuruma yap\u0131lan idari ba\u015fvuru neticesinde SGK taraf\u0131ndan ilac\u0131n kar\u015f\u0131lanmayaca\u011f\u0131na ili\u015fkin olumsuz yan\u0131t\/red gelmesi akabinde ilac\u0131n kar\u015f\u0131lanmas\u0131 i\u00e7in kuruma kar\u015f\u0131 dava a\u00e7\u0131labilecektir. \u0130\u015fbu davan\u0131n g\u00f6r\u00fclmesinde g\u00f6revli mahkeme; 5510 Say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu uyar\u0131nca, kural olarak i\u015f mahkemeleridir.&nbsp;<a href=\"https:\/\/turkishlawblog.com\/insights\/detail\/kanser-ilaclarinin-sosyal-guvenlik-kurumu-tarafindan-karsilanmasi-icin-izlenilmesi-gereken-idari-ve-hukuki-surecler#_ftn1\"><sup>[1]<\/sup><\/a>&nbsp;Ancak 4\/C kapsam\u0131nda Sigortal\u0131 ki\u015filer bak\u0131m\u0131ndan g\u00f6revli mahkeme ise idare mahkemeleridir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SGK taraf\u0131ndan kar\u015f\u0131lanmayan ila\u00e7lar kapsam\u0131nda mahkemelerin davac\u0131 lehine karar verebilmesi i\u00e7in dava dilek\u00e7elerinde:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u25aa\ufe0f&nbsp;Ba\u015fvuruya konu ilac\u0131n kar\u015f\u0131lanmas\u0131 veya geri \u00f6demesi talebinin daval\u0131 kurum taraf\u0131ndan reddine ili\u015fkin i\u015flemin iptali,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u25aa\ufe0f&nbsp;Ba\u015fvurucunun hayati riski nedeniyle tedavisi tamamlan\u0131ncaya kadar, g\u00f6revli mahkemeye g\u00f6re ivedilikle y\u00fcr\u00fctmenin durdurulmas\u0131 veya ihtiyati tedbir karar\u0131 verilerek, ilac\u0131n bedelinin her ay kesinti yap\u0131lmaks\u0131z\u0131n, iskonto uygulanmaks\u0131z\u0131n ve teminat aranmaks\u0131z\u0131n daval\u0131 kurum taraf\u0131ndan kar\u015f\u0131lanmas\u0131na karar verilmesi,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u25aa\ufe0f&nbsp;E\u011fer ba\u015fvurucu, dava konusu ilac\u0131n bedellerini daha \u00f6nce kendi imk\u00e2nlar\u0131yla kar\u015f\u0131lam\u0131\u015f ise bu bedellerin y\u00fcr\u00fctmenin durdurulmas\u0131 veya tedbir karar\u0131 verilene kadar eksiksiz ve noksans\u0131z \u015fekilde davac\u0131ya iadesine ve dava tarihinden itibaren i\u015fleyecek yasal faiziyle birlikte \u00f6denmesine h\u00fckmedilmesi,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">taleplerinin yer almas\u0131 \u00f6nem arz etmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130htiyati tedbir talebi ile bu y\u00f6nde karar verilmesi, tedavinin aksamas\u0131 ve hastan\u0131n ya\u015fam hakk\u0131n\u0131n tehlikeye girece\u011fi durumlarda kritik bir \u00f6neme sahiptir. Kanser ila\u00e7lar\u0131n\u0131n kurum taraf\u0131ndan kar\u015f\u0131lanmas\u0131na y\u00f6nelik ihtiyati tedbir karar\u0131 al\u0131nmas\u0131nda, s\u00f6z konusu ihtiyati tedbirin davan\u0131n esas\u0131n\u0131 \u00e7\u00f6zer nitelikte olmas\u0131 sebebiyle mahkemelerce ihtiyati tedbir talebinin reddedildi\u011fi g\u00f6r\u00fclmektedir&nbsp;<a href=\"https:\/\/turkishlawblog.com\/insights\/detail\/kanser-ilaclarinin-sosyal-guvenlik-kurumu-tarafindan-karsilanmasi-icin-izlenilmesi-gereken-idari-ve-hukuki-surecler#_ftn2\"><sup>[2]<\/sup><\/a>. Ancak burada ihtiyati tedbir karar\u0131n\u0131n verilmemesi halinde, talepte bulunan i\u00e7in hayati sonu\u00e7lar\u0131 olaca\u011f\u0131 ve dava sonu\u00e7lan\u0131ncaya kadar geri d\u00f6n\u00fclemez neticelere yol a\u00e7abilece\u011fi unutulmamal\u0131d\u0131r. Her ne kadar tedbir karar\u0131n\u0131n, davan\u0131n esas\u0131na y\u00f6nelik oldu\u011fu hususu kurum taraf\u0131ndan iddia edilse de \u00fcst mahkeme taraf\u0131ndan HMK\u2019n\u0131n 389. maddesi uyar\u0131nca \u015fartlar\u0131n olu\u015ftu\u011fu g\u00f6zetilerek ihtiyati tedbir talebinin kabul\u00fcne karar verildi\u011fi de g\u00f6z \u00f6n\u00fcnde bulundurulmal\u0131d\u0131r.<a href=\"https:\/\/turkishlawblog.com\/insights\/detail\/kanser-ilaclarinin-sosyal-guvenlik-kurumu-tarafindan-karsilanmasi-icin-izlenilmesi-gereken-idari-ve-hukuki-surecler#_ftn3\"><sup>[3]<\/sup><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Keza, C20-Rektum Malign Neoplazm\u0131 (kolon kanseri) tedavisi g\u00f6ren hastan\u0131n tedavisinde kullan\u0131lacak Lonusrf isimli ilac\u0131n SGK taraf\u0131ndan bedelsiz olarak kar\u015f\u0131lanmas\u0131 talebiyle Ankara 50. \u0130\u015f Mahkemesi nezdinde a\u00e7\u0131lan davada, mahkemece dava sonu\u00e7lan\u0131ncaya kadar ilac\u0131n SGK taraf\u0131ndan kesintisiz ve bedelsiz kar\u015f\u0131lanmas\u0131na ili\u015fkin ara karar tesis edilerek ihtiyati tedbir karar\u0131 verilmi\u015ftir. Ankara 50. \u0130\u015f Mahkemesi\u2019nin 2024\/113 E. dosyas\u0131nda mahkemenin ihtiyati tedbir talebini kabul gerek\u00e7esi ise: \u201c<em>Bilindi\u011fi gibi T.C. Anayasan\u0131n 56. Maddesinde Sa\u011fl\u0131k ve Ya\u015fama Hakk\u0131 d\u00fczenlenmi\u015f, 60. maddesinde de Sosyal G\u00fcvenlik Hakk\u0131 yer almaktad\u0131r. An\u0131lan 56. madde Sa\u011fl\u0131k hizmetleri ve \u00e7evrenin korunmas\u0131 ba\u015fl\u0131\u011f\u0131n\u0131 ta\u015f\u0131makta olup, &#8220;Herkes, sa\u011fl\u0131kl\u0131 ve dengeli bir \u00e7evrede ya\u015fama hakk\u0131na sahiptir. \u00c7evreyi geli\u015ftirmek, \u00e7evre sa\u011fl\u0131\u011f\u0131n\u0131 korumak ve \u00e7evre kirlenmesini \u00f6nlemek Devletin ve vatanda\u015flar\u0131n \u00f6devidir.&nbsp; Devlet, herkesin hayat\u0131n\u0131, beden ve ruh sa\u011fl\u0131\u011f\u0131 i\u00e7inde s\u00fcrd\u00fcrmesini sa\u011flamak; insan ve madde g\u00fcc\u00fcnde tasarruf ve verimi art\u0131rarak, i\u015fbirli\u011fi ger\u00e7ekle\u015ftirmek amac\u0131yla sa\u011fl\u0131k kurulu\u015flar\u0131n\u0131 tek elde planlay\u0131p hizmet vermesini d\u00fczenler.&nbsp; Devlet, bu g\u00f6revini kamu ve \u00f6zel kesimlerdeki sa\u011fl\u0131k ve sosyal kurumlar\u0131ndan yararlanarak, onlar\u0131 denetleyerek yerine getirir. Sa\u011fl\u0131k hizmetlerinin yayg\u0131n bir \u015fekilde yerine getirilmesi i\u00e7in kanunla genel sa\u011fl\u0131k sigortas\u0131 kurulabilir.&nbsp; T.C. Anayasas\u0131n\u0131n 60. maddesi ise; Sosyal G\u00fcvenlik Hakk\u0131 ba\u015fl\u0131\u011f\u0131 ta\u015f\u0131makta olup, herkesin Sosyal G\u00fcvenlik Hakk\u0131na sahip oldu\u011fu ve devletin Sosyal g\u00fcvenli\u011fi sa\u011flamak i\u00e7in gerekli tedbirleri alaca\u011f\u0131 ve te\u015fkilat kuraca\u011f\u0131 kabul edilmi\u015ftir.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Yukar\u0131da a\u00e7\u0131klanan ihtiyati tedbir ko\u015fullar\u0131na d\u00f6nd\u00fc\u011f\u00fcm\u00fczde davac\u0131n\u0131n tedavisinin s\u00fcrd\u00fcr\u00fclmemesi halinde ciddi bir zarar\u0131n meydana gelece\u011fi a\u00e7\u0131kt\u0131r. Kolon Kanseri tedavisi g\u00f6ren davac\u0131n\u0131n etkin ilac\u0131 kullanmamas\u0131 nedeniyle Anayasal g\u00fcvence alt\u0131nda olan sa\u011fl\u0131k ve ya\u015fama hakk\u0131ndan mahrum kalacakt\u0131r. Devlet, herkesin hayat\u0131n\u0131, beden ve ruh sa\u011fl\u0131\u011f\u0131 i\u00e7inde s\u00fcrd\u00fcrmesini sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr. Di\u011fer bir anlat\u0131mla temel insan hakk\u0131 olan ya\u015fama hakk\u0131n\u0131n korunmas\u0131 devletin temel g\u00f6revleri aras\u0131ndad\u0131r. Di\u011fer yandan Sosyal devlet sosyal g\u00fcvenlik hakk\u0131 kapsam\u0131nda devletin sosyal g\u00fcvenli\u011fi sa\u011flama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc de vard\u0131r. Davac\u0131n\u0131n ya\u015fama hakk\u0131n\u0131 tehdit eden hastal\u0131\u011f\u0131n tedavisi devletin Anayasal g\u00f6revleri aras\u0131ndad\u0131r. Tedavi giderlerinin kar\u015f\u0131lanmamas\u0131 davac\u0131n\u0131n ya\u015fama hakk\u0131n\u0131 ihlal niteli\u011finde olabilecek ve davac\u0131 i\u00e7in telafisi imk\u00e2ns\u0131z zararlara neden olabilecektir. \u0130htiyati tedbirin ko\u015fullar\u0131 somut olayda ger\u00e7ekle\u015fti\u011finden davac\u0131n\u0131n ila\u00e7 bedellerinin kurum taraf\u0131ndan kar\u015f\u0131lanmas\u0131na ili\u015fkin tedbir isteminin kabul\u00fc gerekmi\u015ftir.\u201d&nbsp;<\/em>\u015feklindedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130lk derece mahkemesi nezdinde g\u00f6r\u00fclen yarg\u0131lamada tedbir talebinin kabul\u00fcne ek olarak; \u201c<em>Davac\u0131n\u0131n kulland\u0131\u011f\u0131 ilac\u0131n bedelinin daval\u0131 kurum taraf\u0131ndan kar\u015f\u0131lanmamas\u0131n\u0131n nedeni SUT kapsam\u0131nda olmamas\u0131d\u0131r. Yukar\u0131da da a\u00e7\u0131kland\u0131\u011f\u0131 gibi ilac\u0131n SUT kapsam\u0131nda olmamas\u0131 Devletin Sosyal Devlet niteli\u011fine ve sa\u011fl\u0131k hakk\u0131n\u0131 koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc ortadan kald\u0131rmamaktad\u0131r. Hukuk Devleti \u0130lkesinin as\u0131l amac\u0131n\u0131n temel insan haklar\u0131n\u0131 sa\u011flamak oldu\u011fu, en temel insan hakk\u0131n\u0131n ise ya\u015fam hakk\u0131 oldu\u011fu, dolay\u0131s\u0131yla Hukuk Devletinin ilk g\u00f6revinin en temel insan hakk\u0131 olan Ya\u015fam Hakk\u0131n\u0131 korumak oldu\u011fu tart\u0131\u015fmas\u0131zd\u0131r<\/em>\u201d gerek\u00e7esiyle:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u25aa\ufe0f&nbsp;Davac\u0131n\u0131n tedavisinde kullan\u0131lan ilac\u0131n SGK(\u201cKurum\u201d) taraf\u0131ndan kar\u015f\u0131lanmas\u0131 i\u00e7in yap\u0131lan ba\u015fvurunun reddi i\u015fleminin iptaline,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u25aa\ufe0f&nbsp;Lonsurf isimli ilaca ait bedellerin davac\u0131n\u0131n tedavi s\u00fcresi boyunca SGK taraf\u0131ndan \u00fccretsiz ve kesintisiz kar\u015f\u0131lanmas\u0131 gerekti\u011finin tespitine,<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u25aa\ufe0f&nbsp;\u0130lac\u0131n ithali i\u00e7in gerekli \u00f6demenin daval\u0131 Kurum taraf\u0131ndan do\u011frudan T\u00fcrk Eczac\u0131lar Birli\u011fine \u00f6denmesine karar verilmek suretiyle en nihayetinde davac\u0131 hasta lehine davan\u0131n kabul\u00fcne karar verilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu kapsamda, ilk derece mahkemesinin karar\u0131 ile mahkemenin, Anayasal haklar\u0131n korunmas\u0131 ba\u011flam\u0131nda devletin sosyal g\u00fcvenlik ve sa\u011fl\u0131k hizmetleri alan\u0131ndaki pozitif y\u00fck\u00fcml\u00fcl\u00fcklerini a\u00e7\u0131k bir \u015fekilde ortaya koymakta ve bireylerin ya\u015fama hakk\u0131 ile sa\u011fl\u0131k hizmetlerine eri\u015fim haklar\u0131n\u0131n yarg\u0131sal g\u00fcvencelerle nas\u0131l desteklendi\u011fini g\u00f6stermektedir.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\" id=\"13-ilacin-kurum-tarafindan-karsilanmasi-gerektigine-iliskin-emsal-kararlar\"><strong>1.3. \u0130lac\u0131n Kurum Taraf\u0131ndan Kar\u015f\u0131lanmas\u0131 Gerekti\u011fine \u0130li\u015fkin Emsal Kararlar<\/strong><\/h5>\n\n\n\n<p class=\"wp-block-paragraph\">S\u00f6z konusu dava kapsam\u0131nda yarg\u0131 kararlar\u0131n\u0131n dava dilek\u00e7elerinde bulunmas\u0131 \u00f6nem arz etmektedir. Yarg\u0131tay Hukuk Genel Kurulu; ila\u00e7 bedelinin Kurumca kar\u015f\u0131lanmas\u0131 y\u00f6n\u00fcnden \u00f6ng\u00f6r\u00fclen hastan\u0131n sa\u011fl\u0131\u011f\u0131na kavu\u015fmas\u0131 ve hastal\u0131\u011f\u0131n iyile\u015fmesi ko\u015fulunun hastal\u0131\u011f\u0131n mahiyeti dikkate al\u0131nd\u0131\u011f\u0131nda kat\u0131 bir yakla\u015f\u0131m oldu\u011funu bu nedenle davaya konu ilac\u0131n davac\u0131n\u0131n hastal\u0131\u011f\u0131n\u0131n ilerlemesine engel olup olmad\u0131\u011f\u0131 veya gerilemesini sa\u011flay\u0131p sa\u011flamad\u0131\u011f\u0131, ya\u015fam kalitesini art\u0131r\u0131p art\u0131rmad\u0131\u011f\u0131, ya\u015fam s\u00fcresinin uzamas\u0131na katk\u0131da bulunup bulunmad\u0131\u011f\u0131 konusunda sa\u011fl\u0131k kurulu raporu al\u0131narak sonucuna g\u00f6re karar verilmesi gerekti\u011fini belirtmi\u015ftir.<a href=\"https:\/\/turkishlawblog.com\/insights\/detail\/kanser-ilaclarinin-sosyal-guvenlik-kurumu-tarafindan-karsilanmasi-icin-izlenilmesi-gereken-idari-ve-hukuki-surecler#_ftn4\"><sup>[4]<\/sup><\/a>&nbsp;Bu karardan da anla\u015f\u0131laca\u011f\u0131 \u00fczere, ilac\u0131n kurum taraf\u0131ndan \u00f6denmesi gerekip gerekmedi\u011fi tart\u0131\u015f\u0131l\u0131rken; ilac\u0131n hastal\u0131\u011f\u0131 iyile\u015ftirecek nitelikte olmas\u0131ndan ziyade, ki\u015finin ya\u015fam kalitesine olumlu etkide bulunmas\u0131 veya hastal\u0131\u011f\u0131n ilerlemesini engelleyici nitelikte olmas\u0131 hususlar\u0131n\u0131n dikkate al\u0131nmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Avrupa \u0130nsan Haklar\u0131 Mahkemesi (A\u0130HM),&nbsp;<em>ya\u015fam hakk\u0131n\u0131 koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn yaln\u0131zca devletlerin mali kaynaklar\u0131na dayand\u0131r\u0131lamayaca\u011f\u0131na h\u00fckmetmi\u015ftir<\/em>&nbsp;ve A\u0130HM,&nbsp;<em>bireylerin ya\u015fam hakk\u0131n\u0131 do\u011frudan etkileyen tedavi ve ila\u00e7lar\u0131n eri\u015filebilir olmas\u0131n\u0131 devletlerin pozitif y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olarak de\u011ferlendirmi\u015ftir<\/em>.<a href=\"https:\/\/turkishlawblog.com\/insights\/detail\/kanser-ilaclarinin-sosyal-guvenlik-kurumu-tarafindan-karsilanmasi-icin-izlenilmesi-gereken-idari-ve-hukuki-surecler#_ftn5\"><sup>[5]<\/sup><\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"2-sosyal-devlet-ilkesi-ve-anayasal-yukumlulukler\"><strong>2) SOSYAL DEVLET \u0130LKES\u0130 VE ANAYASAL Y\u00dcK\u00dcML\u00dcL\u00dcKLER<\/strong>&nbsp;<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Anayasa\u2019n\u0131n 2., 5., 17., 56., 60. ve 65. maddeleri g\u00f6z \u00f6n\u00fcnde bulunduruldu\u011funda, sosyal devlet ilkesinin bireylerin sa\u011fl\u0131k hizmetlerine eri\u015fimini de kapsad\u0131\u011f\u0131 tart\u0131\u015fmas\u0131zd\u0131r. Nitekim sa\u011fl\u0131k hizmetlerine eri\u015fim, ya\u015fam hakk\u0131n\u0131n da en \u00f6nemli g\u00fcvencelerinden biridir. Sosyal devlet ilkesinin benimsendi\u011fi \u00fclkelerde; bireylerin temel hak ve h\u00fcrriyetleri devlet taraf\u0131ndan etkin bir \u015fekilde korunmal\u0131d\u0131r. Anayasa\u2019n\u0131n 60. maddesi ile g\u00fcvence alt\u0131na al\u0131nan Sosyal G\u00fcvenlik Hakk\u0131 kapsam\u0131nda devlet, bireylerin sosyal g\u00fcvenli\u011fini sa\u011flayacak gerekli tedbirleri almakla y\u00fck\u00fcml\u00fcd\u00fcr. Bu sebepledir ki, dava dilek\u00e7elerinde Anayasa\u2019n\u0131n ilgili h\u00fck\u00fcmlerine ve sosyal devlet gerekliliklerine de\u011finilmesi \u00f6nem arz etmektedir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\" id=\"sonuc\"><strong>SONU\u00c7<\/strong>&nbsp;<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Kanser tedavisinde kullan\u0131lan ila\u00e7lar\u0131n SGK taraf\u0131ndan kar\u015f\u0131lanmas\u0131 s\u00fcreci, bireyin ya\u015fam hakk\u0131n\u0131 g\u00fcvence alt\u0131na alan anayasal ve uluslararas\u0131 normlar\u0131n etkin bir \u015fekilde uygulanmas\u0131n\u0131 gerektirir. Hukuki ve idari s\u00fcre\u00e7lerin karma\u015f\u0131kl\u0131\u011f\u0131, hasta ve yak\u0131nlar\u0131n\u0131n tedaviye eri\u015fim m\u00fccadelesini zorla\u015ft\u0131rmaktad\u0131r. Bu nedenle, dava dilek\u00e7elerinde yarg\u0131 mercilerinin emsal kararlar\u0131 ve uluslararas\u0131 standartlar \u0131\u015f\u0131\u011f\u0131nda bireyin ya\u015fam hakk\u0131n\u0131 \u00f6nceliklendiren bir dil kullan\u0131lmas\u0131 ve yakla\u015f\u0131m benimsenmesi \u00f6nem arz etmektedir.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sonu\u00e7 olarak, ya\u015fam hakk\u0131n\u0131n korunmas\u0131 \u015f\u00fcphesiz sosyal devletin pozitif bir y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc olup, bireylerin sa\u011fl\u0131k hizmetlerine eri\u015fimi, yaln\u0131zca ki\u015finin iyile\u015fmesi ihtimalinde de\u011fil, ilgili sa\u011fl\u0131k hizmetlerinin ve ila\u00e7lar\u0131n bireyin ya\u015fam\u0131na olumlu katk\u0131da bulunacak, hastal\u0131\u011f\u0131n\u0131 ilerletmeyecek veya ya\u015fam kalitesini art\u0131racak nitelikteyse devlet, vatanda\u015f\u0131n bu hizmetlere etkin ula\u015fmas\u0131n\u0131 sa\u011flanmas\u0131 gerekmektedir.
